1.1 Account Creation

To fully utilize the Services, users must create an account. However, limited access is available without an account.

When you create an account on Listresume, you are fully responsible for maintaining its security and any activities that occur under your account. Please use a strong password or authenticate via a third-party service (e.g., Google) to ensure that your private information, your resumes, and billing information are secure.

We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

1.3 Account Types

We offer both free and paid account types. The features available to you depend on the type of account you choose.

2. Subscription Fees

2.1 Payment Terms

Listresume reserves the right to require payment or subscription fees for any of our Services. At the beginning of each billing period, you will be automatically charged for the entire period.

2.2 Pricing Changes

Prices may be changed at any time, with thirty (30) days prior notice to you, which may be sent by email or posted on the website. Your continued use of the Services following such notification constitutes your acceptance of any new or increased charges.

2.3 Downgrading Plans

Downgrading your plan may cause the loss of access to some capabilities of your account. Listresume does not accept any liability for such loss.

3. Payment and Refunds

3.1 Payment Methods

We accept payments through Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

3.2 Refund Policy

We offer a one-week, no-questions-asked refund policy for subscription fees. To request a refund, you must contact us within one week of your initial purchase.

3.3 Refund Conditions

Refunds are only granted within one week of purchase. After this period, users are not eligible for refunds.

4. Content

4.1 User-Generated Content

Users may create or upload resumes to our platform. This includes text, formatting, and any other relevant information contained within the resume.

4.2 Ownership of Content

You retain ownership of all content you create or upload to our platform. By using our Services, you grant us a limited license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, and distribute such content solely for the purpose of providing the Services.

4.3 Content Moderation

While we do not actively monitor user-generated content, we reserve the right to review and remove any content that violates our policies or is deemed inappropriate. Prohibited content includes, but is not limited to, content that is illegal, offensive, defamatory, or infringes upon the rights of others.

5. Cancellation and Termination

5.1 Cancellation

If you no longer need our Services, you can cancel your subscription or account through the dashboard at any time. There are no fees or penalties for cancellation.

5.2 Termination by Listresume

We reserve the right to terminate your account for any reason, including but not limited to abuse of the Services, violation of these Terms, or any other behavior that we deem inappropriate. Upon termination, your account will be deactivated or deleted, and all content within your account will be forfeited. In such cases, you are not eligible for any refunds.

5.3 Termination by User

If you wish to terminate your account, you may do so through the Account page in your dashboard.

6. Privacy and Data Protection

6.1 Privacy Policy

Your personal information and content are governed by our Privacy Policy. By using Listresume, you agree to our Privacy Policy.

7. Limited Warranties and Liability

Listresume, LLC provides the Services "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied. We do not guarantee the reliability, security, or accuracy of the Services or user data, despite our best efforts.

7.1 Limitation of Liability

To the fullest extent permitted by law, Listresume, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services;
• Unauthorized access, use, or alteration of your transmissions or content.

7.2 Indemnification

You agree to indemnify, defend, and hold harmless Listresume, LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services.

7.3 No Right to Sue

By using the Services, you agree that you will not hold Listresume, LLC liable for any damages arising out of or related to your use of the Services, and you waive any right to bring a legal action against us for such damages.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services and supersede and replace any prior agreements we might have between us regarding the Services.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect by posting a notice on our website or by sending you an email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Services.
